In the wake of new travel rules for Canadians in the United States and the increased crackdown on Canadians in the US, immigration lawyers suggest that people should travel to the US with a burner phone and not their actual phones because US customs officials can look through their mobile phones, check social media comments and download all data. The concept of privacy is completely different in the United States now, lawyer Heather Segal told CBC News.
‘No one knows what they are afraid of’
Segal told the news outlet that she is flooded with emails from Canadian citizens entering the US, even US citizens entering the US, transgender people going to the US, Canadian immigrants and everyone is afraid but they don’t know what they are afraid of. “There’s a fear, but no one’s exactly sure what they’re afraid of. They don’t know what they’ve done wrong. There’s a sense of guilt, but ‘I don’t know what I did,” Segal said.
Segal said she is recommending Canadians to clear US customs while in Canada — to choose an airport where they can do that as they will be on Canadian soil. And at any point, they can just refuse to travel and they won’t be arrested because they are still on Canadian soil.
According to the updated travel guidelines, Canadians visiting the US for more than 30 days will be required to register themselves with the US government.
Another immigration lawyer Ravi Jain told CBC that taking a burner phone is a good ides and said he’s advising his clients born in Iran and Syria not to go to the US now.
Global Affairs Canada has updated its official travel advice for the United States to reflect a new registration requirement for Canadians planning extended stays. As of April 11, 2025, US authorities will require all foreign nationals visiting for longer than 30 days to register with the US Citizenship and Immigration Services (USCIS).
The updated advisory does not raise the travel risk level from “take normal security precautions” but adds guidance for long-term visitors. The rule applies to travellers aged 14 and older who haven’t already gone through a registration and fingerprinting process during a past U.S. visa application. Canadians entering under a work visa or another nonimmigrant category who were issued an I-94 are generally considered registered and may be exempt from this new step.
